General
CaseStacks LLC ("CaseStacks," "we," "us," or "our") operates the CaseStacks platform, website (www.casestacks.com), and other related services (collectively, the "Services"). These Terms of Service (the "Terms"), together with our Privacy Policy, govern your use and access to the Services. This includes your access to educational materials, cases, images, and DICOM files provided on the Services (the "Content").
Please read these Terms carefully. By accessing or using the Services, you acknowledge that you have read, accept, and agree to be bound by these Terms.
Description of the Services
CaseStacks is a radiology education platform providing:
- Interactive radiology cases with DICOM viewers
- Educational courses and assessments
- Anatomy modules and learning resources
- On-call reference tools and quick guides
- Call preparation simulator
- AI-powered educational tools
- CME credit opportunities
- Progress tracking and analytics
Account Registration
The Services are intended for medical professionals and students enrolled in healthcare education programs. Many features of the Services are limited to users with accounts.
By creating or accessing an account, you agree to:
- provide accurate, current, and complete registration information;
- maintain and promptly update your account information as needed;
- keep your login credentials confidential and secure;
- not share your account or permit anyone else to access it; and
- remain responsible for all activities occurring under your account.
We enforce single-session login restrictions to prevent account sharing. Logging in from a new device will automatically log out your previous session. Attempting to circumvent these restrictions may result in account termination.
Prohibited Conduct
You agree not to use the Services or any Content for any unlawful, harmful, or unauthorized purpose. Prohibited conduct includes, but is not limited to:
- Gaining or attempting to gain unauthorized access to any part of the Services, our servers, or related systems, or probing, scanning, or testing their vulnerability;
- Circumventing any security feature, authentication measure, login restriction, session control, or subscription limit;
- Using automated means (e.g., bots, scrapers, crawlers, etc.) to access, monitor, copy, or collect the Content or other data from the Services;
- Interfering with or disrupting the Services, including through viruses, malware, harmful code, or activities that damage, disable, or overburden the platform;
- Using ad-blocking or content-blocking tools in a way that interferes with the proper operation of the Services;
- Providing false, misleading, or inaccurate information, or impersonating any person or entity;
- Transmitting spam, unsolicited messages, or advertising;
- Posting or transmitting content that is abusive, harassing, defamatory, discriminatory, or otherwise harmful;
- Uploading Protected Health Information or patient-identifying information into any part of the Services where such use is not expressly authorized;
- Creating additional accounts to evade restrictions, manipulate referrals, abuse promotions, or otherwise circumvent these Terms;
- Downloading, copying, screenshotting, recording, reproducing, distributing, storing, selling, or sublicensing any Content except as expressly permitted by these Terms;
- Reverse engineering, decompiling, disassembling, or attempting to derive source code or underlying technology from the Services;
- Using the Services or any Content for commercial purposes, resale, competitive analysis, or to create/improve/support/compare a competing product or service;
- Using the Services or any Content to develop, train, fine-tune, benchmark, or otherwise improve any artificial intelligence or machine learning model without our prior written consent;
- Collecting or harvesting user information or Content from the Services without our prior written consent; and
- Violating any applicable laws or regulations or using the Services in any manner inconsistent with their intended educational purpose.
If you engage in prohibited conduct, we reserve the right to suspend or terminate your access and take any other appropriate action, including legal action.
License and Assignment of Submissions and User Content
By submitting content, you grant CaseStacks and its affiliates, licensees, successors, and assigns a worldwide, non-exclusive, transferable, sublicensable, assignable, royalty-free, perpetual, and irrevocable license to use, reproduce, host, store, modify, create derivative works from, distribute, publicly perform, publicly display, digitally perform, sell, offer for sale, import, and otherwise exploit that content in any media now known or later developed, for any purpose.
You represent and warrant that you have all rights necessary to grant this license, including permissions from any individuals whose names, images, voices, or likenesses appear in the content.
Medical & Educational Disclaimers
The Services are provided for educational purposes only and are not a substitute for professional medical judgment, clinical training, and faculty supervision. All Content, including case presentations, diagnostic writeups, teaching points, differential diagnoses, and imaging descriptions, are provided "as is" and may contain errors, omissions, outdated information, or reflect practices that have since been updated.
Please note that cases may be simplified or edited for instructional purposes and do not represent the standard of care. You are solely responsible for verifying all Content against current literature and authoritative clinical guidelines before applying it in any clinical context.
The Services are intended to supplement, not replace, formal medical education and should not be used to make patient care decisions. All Content is subject to revision and may be updated or corrected at any time without notice. Where translations are available, they are provided for convenience only and may contain errors; the English version is authoritative in all cases.
Artificial Intelligence
CaseStacks offers AI-powered educational tools to enhance your learning. These tools do not provide medical advice. By using any AI feature, you understand and agree that:
- CaseStacks owns and retains all rights, title, and interest in the AI-powered tools, including the models, prompts, system design, and outputs.
- All AI outputs may contain errors, inaccuracies, hallucinations, or outdated information
- The AI tools provided via the Services are educational aids; users must verify all outputs against authoritative sources before any clinical application
- You must never enter Protected Health Information (patient names, MRNs, dates of birth, or any identifying information)
- You are solely responsible for verifying accuracy and for how you use AI-generated content
AI features have usage limits that vary by subscription tier. Limits, pricing, and available AI features are subject to change at our discretion. Current limits are displayed on your dashboard and pricing page. For details on how AI tools handle your data, see our Privacy Policy.
CME Credits
AMA PRA Category 1™ Continuing Medical Education (CME) credits are available for eligible paid subscribers. CME activities are jointly provided by CaseStacks and our accrediting partner.
- CME credits are available only to paid subscribers (free accounts do not qualify)
- Credits are earned by completing qualifying cases and courses
- Each case awards credit once per user
- Credit limits vary by subscription plan
- A claiming fee is required to process and receive your CME certificate
- When claiming credits, you must provide your name, degree, and email address, which will be shared with our accrediting partner for certificate processing
Current credit limits, claiming fees, and eligibility requirements are available on our CME page. Credit limits, fees, and CME program terms are subject to change at our discretion.
We reserve the right to deny CME claims for suspected fraud, including claiming credit for unviewed content or misrepresenting participation.
Referral Program
We offer a referral program that rewards users for recommending CaseStacks. Participation is subject to these conditions:
- Referral codes are for genuine recommendations only
- Self-referrals and creating multiple accounts for referrals are prohibited
- Referral spam or unsolicited bulk promotion is prohibited
- We reserve the right to void fraudulent referrals and suspend accounts engaged in referral abuse
- Reward amounts, payout methods, and program terms may be modified at our discretion
Current referral rewards and payout details are available in your account settings. Minimum payout thresholds may apply.
Subscription Plans & Payment
The following subscription plans are available for access to the Services:
- Free Access: Limited access to Content at no cost.
- Individual Subscriptions: Subscription plans offered on a quarterly or annual basis for individual users.
- Program Subscriptions: Subscription plans providing institutional access for residency programs and medical schools, subject to separate agreements.
All prices are listed in U.S. dollars unless otherwise stated. Payments are processed through our third-party payment provider, Stripe. Subscriptions do not auto-renew. Access is granted for the chosen billing period (quarterly, semi-annual, or annual) and expires automatically at the end of that period. No further charges will be made unless you choose to purchase a new subscription. Pricing may vary based on your geographic location. You do not acquire any rights to use the Services until the total purchase price is received by us. Failed or disputed payments may result in immediate suspension of access.
Promotional Codes. Promotional codes and coupons are valid only when used as specified and within the applicable timeframe. Unless otherwise stated, they may not be combined with other offers and may be subject to usage limits or additional restrictions. We reserve the right to void any promotional codes that are obtained or used fraudulently.
Refund Policy
Individual Subscribers: All US-based individual subscribers may request a full refund within three (3) calendar days of the date of purchase by emailing support@casestacks.com with your order number and reason for the request. Approved refunds will be issued to the original payment method within five (5) to ten (10) business days, and access to the Services will be revoked upon approval. After the three-day period has expired, no refunds will be provided. CME processing fees are non-refundable once a certificate has been issued, and promotional or discounted plans are subject to the same three-day refund window.
European Union: If you are a consumer in the European Union, you may have a 14-day right to cancel your purchase. If you check the consent box at checkout to receive immediate access to the Services, you agree to waive that 14-day cancellation right. If you do not check the consent box, you will preserve your 14-day cancellation right, but you will not receive immediate access to paid content. To exercise your withdrawal right, contact us at support@casestacks.com within the applicable period.
Program and Institutional Subscriptions: Refunds for program or institutional subscriptions may be governed by separate agreements with your affiliated institution that are not covered by this policy. Program administrators should contact us directly at support@casestacks.com regarding any billing or refund inquiries.
Intellectual Property
All content included in or made available through the Services, and the functionality of the Services, including without limitation cases, images, text, DICOM files, graphics, software, and other materials, and the trade secrets, trademarks, service marks, and copyrights contained therein, are owned by CaseStacks or its licensors and are proprietary and protected by applicable intellectual property laws.
No express or implied rights are conferred on you except for a limited, non-exclusive, non-transferable license to access and use the Services and its content solely for your personal, non-commercial educational purposes. Except as expressly permitted by these Terms, such content may not be copied, reproduced, distributed, modified, or otherwise exploited without our prior written consent.
DMCA/Copyright Policy
We respect the intellectual property rights of others and expect our users to do the same. If you believe that content available through the Services infringes your copyright, you may submit a written notice to our designated agent that includes the following:
- A description of the copyrighted work you claim has been infringed;
- A description of where the allegedly infringing material is located on the Services, with sufficient detail for us to locate it;
- Your contact information, including name, address, telephone number, and email address;
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and
- Your physical or electronic signature.
Please send copyright notices to the address listed in the "Contact Information" section below. We will respond to valid notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
Account Security
You are responsible for keeping your account credentials secure and confidential. You may not share your account or login information with anyone else. We may use login limits, session controls, device restrictions, or other security measures to prevent unauthorized access and account sharing. You agree not to bypass these measures.
You must notify us immediately at support@casestacks.com if you believe your account has been accessed without authorization.
Monitoring
We are not required to monitor the Services; however, you acknowledge and agree that CaseStacks has the right to monitor the Services electronically from time to time. This may include monitoring account activity, use of Content, CME activity, AI tool usage, and other activity on the Services.
We may use this information: (i) as necessary or appropriate to satisfy any legal/government request, (ii) to operate the Services, (iii) to protect itself or other users of the Services, and (iv) for any other legal purpose.
Data Security
While we implement reasonable security measures to protect your data, no system is completely secure, and we cannot guarantee the absolute data security of our website and related services. Furthermore, we cannot guarantee that the data you provide us will not be intercepted during transmission. For more information about our privacy practices please visit our Privacy Policy.
We use reasonable efforts to keep the Services available, but the Services may be unavailable from time to time due to maintenance, repairs, updates, third-party outages, security issues, or other causes beyond our control. We do not guarantee uninterrupted availability of the Services. We may suspend or limit access to the Services at any time for operational, security, legal, or business reasons. When reasonably possible, we will try to provide advance notice of planned downtime.
Third-Party Websites
You may find links on our website that direct you to third-party websites, and third-party websites may also link to our website (collectively, "Linked Sites"). You agree that we have no responsibility for the information, content, products, services, advertising, code, or other materials which may or may not be provided by or through Linked Sites. Providing a link to Linked Sites does not constitute an endorsement or sponsorship by us of such websites or the information, content, products, services, advertising, code, or other materials presented on or through such websites. Any reliance on the contents of a third-party website is done at your own risk and you assume all responsibilities and consequences resulting from such reliance.
Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any content, goods, or services available on any other website.
Disclaimer of Warranties
THE SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, CASESTACKS DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, AS TO: (A) THE SERVICES; (B) THE CONTENT; OR (C) SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TO THE SERVICES. IN ADDITION, CASESTACKS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, THAT ANY RESULTS WILL BE ACHIEVED, NON-INFRINGEMENT, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION AND FREEDOM FROM COMPUTER VIRUS.
CASESTACKS DOES NOT REPRESENT OR WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICES OR THE SERVER THAT MAKES THE SERVICES AVAILABLE IS FREE FROM ANY HARMFUL COMPONENTS, INCLUDING, WITHOUT LIMITATION, VIRUSES. CASESTACKS DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES THAT THE INFORMATION (INCLUDING ANY APPLICATION INSTRUCTION) ON THE SERVICES IS ACCURATE, COMPLETE, OR USEFUL. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. CASESTACKS DOES NOT WARRANT THAT YOUR USE OF THE SERVICES IS LAWFUL IN ANY PARTICULAR JURISDICTION, AND CASESTACKS SPECIFICALLY DISCLAIMS SUCH WARRANTIES. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTION'S LAW IS APPLICABLE TO YOU AND THESE TERMS.
BY ACCESSING OR USING THE SERVICES YOU REPRESENT AND WARRANT THAT YOUR ACTIVITIES ARE LAWFUL IN EVERY JURISDICTION WHERE YOU ACCESS OR USE THE SERVICES.
Limitation of Liability; Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASESTACKS BE LIABLE TO YOU OR ANY THIRD PARTY FOR DAMAGES OF ANY KIND ARISING OUT OF THE USE OF, ACCESS TO, RELIANCE ON, INABILITY TO USE OR IMPROPER USE OF THE SERVICES (INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR DAMAGES FOR LOSS OF PROFITS, TRADING LOSSES, GOODWILL OR REVENUE, BUSINESS INTERRUPTION, OR LOSS OF DATA), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.
CERTAIN STATE LAWS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES, AND THUS SOME OR ALL OF THE EXCLUSIONS OR LIMITATIONS ABOVE MAY NOT APPLY TO YOU.
Indemnification
You understand and agree that you are personally responsible for your use of/behavior on the Services. Furthermore, you agree to indemnify CaseStacks and its affiliated companies, business partners, licensors, employees, and agents, from and against all claims, losses, expenses, damages, and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use of the Services or your violation of these Terms.
Service Disclosures
The Services may provide general information about CaseStacks and the services we offer. The services may not be available in all jurisdictions.
CaseStacks may discontinue or make changes to the Content provided on the Services at any time. Any dated information is published as of its publication date only. CaseStacks does not undertake any obligation or responsibility to update or amend any such information. CaseStacks reserves the right to terminate any or all services/other offerings without prior notice. Furthermore, by offering information through the Services, no solicitation is made by CaseStacks to any person to use such information or services when unavailable or otherwise prohibited by law.
E-mail Communications
Please contact us using the information provided below if you would like to stop receiving emails from CaseStacks. Our email newsletters include an "unsubscribe" link that may also be used to limit further email communications.
You are solely responsible for ensuring that you have the necessary rights and permissions to post any content, including from individuals depicted or referenced in your content. Failure to follow these rules may result in suspension or termination of access to the Services.
Assignment
You may not assign, delegate, or otherwise transfer these Terms or any of your rights or obligations under these Terms without our prior written consent. Any attempted transfer in violation of this section is void. We may assign these Terms freely, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
No Use of Services by Minors
Our Services are not directed at or intended for use by persons under 13 years old. If you are under the age of 13 you should not be visiting the Services. We do not knowingly collect or retain personal information from persons under the age of 13. If you are under the age of 13 and are visiting the Services, please exit immediately and do not disclose or provide any information to us. If you are a parent or guardian who thinks your child has disclosed information to us, please contact us so that we can remove that from our systems.
Governing Law and Jurisdiction
We prefer to resolve disputes amicably and ask that you contact us first at info@casestacks.com to allow us an opportunity to address your concerns. If a dispute cannot be resolved informally within thirty (30) days, any dispute, claim, or controversy arising out of or relating to these Terms shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions, and shall be resolved through binding arbitration in Forsyth County, North Carolina. You agree that any such proceedings shall be conducted on an individual basis only, and not as part of any class, consolidated, or representative action.
Notwithstanding the foregoing, either party may bring an eligible claim in small claims court located in Forsyth County, North Carolina. You may opt out of this arbitration provision by providing written notice to info@casestacks.com within thirty (30) days of accepting these Terms.
Local Standards
We do not represent that materials on the Services are appropriate for use in all locations. Persons who choose to access the Services do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you and CaseStacks, except as expressly stated herein.
Electronic Communications
By using the Services, you consent to receive communications from us electronically, including by email, or by posting notices through the Services. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Force Majeure
We're not liable for failures due to circumstances beyond our reasonable control, including but not limited to:
- Distributed denial-of-service (DDoS) attacks, cyber attacks, or other malicious activity targeting our infrastructure
- Outages, failures, or service disruptions from our cloud hosting providers (Google Cloud Platform)
- Third-party service failures (payment processors, AI providers, CDN providers)
- Internet backbone disruptions or widespread connectivity issues
- Natural disasters affecting data centers or network infrastructure
- Power outages or utility failures beyond our control
We will make reasonable efforts to restore service promptly and communicate status updates during any extended outage.
Updates
CaseStacks reserves the right to modify these Terms at any time without providing prior notice. Your use of the Services following any such modification constitutes your agreement to follow and be bound by the Terms as modified. For this reason, we encourage you to review the provisions included herein when you use the Services. The latest revision date is set forth at the beginning of this document.
Entire Agreement
These Terms comprise the entire agreement between you and CaseStacks relating to your use of the Services, and supersede all prior agreements and negotiations, whether oral or written. These Terms supersede any previous terms and conditions relating to use of the Services to which you and CaseStacks may have been bound. Except as set forth herein, there are no other agreements, understandings, promises or conditions, oral or written, express or implied, concerning the subject matter of these Terms.
Termination
We reserve the right to suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including but not limited to:
- Violation of these Terms or our Privacy Policy;
- Conduct that we determine, in our sole discretion, is harmful to other Users, third parties, or the Services;
- Fraudulent, abusive, or illegal activity, including misuse of the referral programs;
- Non-payment or disputed charges; or
- Extended periods of account inactivity.
Upon termination, any provisions of these Terms that by their nature should survive termination will continue to apply. You may terminate your account at any time by contacting us at support@casestacks.com or through your account settings. Termination of your account does not entitle you to a refund except as provided in the Refund Policy above.
We will make reasonable efforts to notify you of any suspension or termination, though we reserve the right to act without prior notice where circumstances warrant, such as in cases of suspected fraud or security threats.
Miscellaneous
Our failure to exercise or enforce any right or provision included herein shall not constitute a waiver of such right or provision. Any waiver of any provision by CaseStacks must be made in writing and signed by an authorized representative of CaseStacks. Such waiver must specifically reference the Terms as well as the provision to be waived. Neither the course of conduct between the parties nor trade practice shall act to modify any provision included herein. Headings used in these Terms are included for convenience only and are not to be relied upon or used to construe any provision. All rights not expressly granted herein are hereby reserved. The Terms will inure to the benefit of, and are intended to be enforceable by, CaseStacks's successors, assigns and licensees.
Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and if it cannot be so modified, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
